Decoding the Insolvency and Bankruptcy Code

A special programme was organised by the Indo-Japan Chamber of Commerce and Industry for on Friday, [27th April, 2019] to asses the impact of the insolvency law on payables and receivables.
Mr.KK Balu, former judge, Company Law Board and Senior Legal Advisor at A K Mylsamy & Associates, and Mr.PS Suman, Corporate Lawyer, A K Mylsamy & Associates lucidly explained what the law entails while also shedding light on the merits and demerits of the current Code.
IBC 2.0 Initial hiccups; the way forward

Mr.K.K. Balu head the panel discussion on “IBC 2.0 – the initial hiccups and the way forward” in National e-Governance Services Limited (NeSL) on 18th March, 2019.
The focus of his discussion was on the initial challenges faced in interpreting the legislation on insolvency and also how we need to look ahead in its effective implementation.
Insolvency and Bankruptcy Law – impact on Receivables Management

On 19th February, 2019 Mr. K K. Balu and Mr. P.S.Suman addressed members of the NASSCOM on the Insolvency and Bankruptcy law and its impact on Receivables Management. Mr. Balu spoke in detail about (a) concept of financial creditors & financial creditors, (b) priority in settlement of dues of corporate debtors, (c) defence available to members when proceedings are initiated under the Code, (d) recent case laws rendered by NCLT/NCALT/Supreme Court in connection with the Code, (d) recent amendments etc.
Mr. Suman gave an account of the objects and purpose of the Code, various recovery measures available to members of NASSCOM on recovery of receivables. He also touched upon the practical aspects of operational creditors and financial creditors and gave presented a detailed analysis of the implications of the Code on corporate debtors and preventive measures to be adopted by members to escape from the consequences of the Code. He rounded off by sharing data on the current status of the IBC proceedings.
Prevention of Sexual Harassment at workplace
18th September, 2018 & 6th March, 2019
Ms. Subathra Mylsamy addressed at the management, staff and employees of Derby Clothing Pvt ltd on 18th September, 2018 and Stella Maris college on 6th March, 2019 on the legislation – the Prevention of Sexual Harassment at workplace. While addressing the basics of the legislation, she spoke about the all important aspect of the Act – when to say “NO” and the methods of dealing with sexual harassment at work place.
While throwing light on instances of sexual harassment, she dealt with how big corporates deal with such cases. Issues such as setting up an internal complaints committee, initiatives of the government and creating awareness amongst people were identified as the need of the hour.
